1. Acceptance of Terms
By accessing or using the Claudessa platform, operated by Daemon Ventures LLC, including our website, mobile applications, voice services, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you may not access or use the Service. Your continued use of the Service following any modifications to these Terms constitutes acceptance of those modifications.
These Terms, together with our Privacy Policy, form the complete agreement between you and Claudessa regarding your use of the Service.
2. Service Description
Claudessa is an AI-powered phone receptionist designed for home services businesses, including but not limited to HVAC, plumbing, electrical, and general contracting companies. The Service provides:
- 24/7 AI Call Answering: An artificial intelligence agent answers incoming calls to your business phone number around the clock, handling customer inquiries, capturing caller information, and routing urgent matters according to your preferences.
- Voice-Based Onboarding: During setup, an AI agent calls you directly to learn about your business through natural conversation. This voice-based onboarding process builds a comprehensive knowledge base that enables the AI to accurately represent your business to callers.
- Appointment Booking: The AI can schedule appointments on your behalf based on availability rules and preferences you configure during onboarding.
- Call Summaries and Logs: Detailed summaries, transcriptions, and analytics for every call handled by the Service, accessible through your online dashboard.
- Customer Dashboard: A web-based interface for managing your account, reviewing call activity, updating business information, and configuring call handling preferences.
The specific features available to you depend on your subscription plan (see Section 6).
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Service. The Service is intended for use by businesses operating in the United States. By using the Service, you represent and warrant that you meet these eligibility requirements.
Claudessa reserves the right to refuse service, terminate accounts, or cancel subscriptions at its sole discretion, particularly if we determine that the Service is being used for purposes inconsistent with its intended use for legitimate home services businesses.
4. Account Registration
To use the Service, you must create an account by providing accurate and complete information, including your business name, contact information, and phone number. You are responsible for:
- Maintaining the accuracy of your account information
- Keeping your login credentials secure and confidential
- All activity that occurs under your account
- Notifying Claudessa immediately of any unauthorized access to your account
You may not share your account credentials with third parties or allow multiple individuals to use the same account unless your subscription plan explicitly permits multiple users.
5. Free Trial
Claudessa offers a two-month (60-day) free trial for new subscribers. The free trial includes full access to the features of your selected plan. No credit card is required to start the free trial.
At the end of the free trial period, you will be prompted to enter payment information to continue using the Service. If you do not provide payment information, your account will be downgraded and call answering will be suspended until a paid subscription is activated.
Claudessa reserves the right to modify, limit, or discontinue the free trial offer at any time. Each business entity is limited to one free trial. Attempts to create multiple accounts to obtain additional free trial periods may result in account termination.
6. Subscription Plans and Pricing
Claudessa offers the following monthly subscription plans:

All plans include AI call answering, voice-based onboarding, call summaries, and dashboard access. Higher-tier plans may include additional features such as priority support, advanced analytics, appointment booking integrations, and custom call handling rules. Prices are quoted in U.S. dollars and are subject to change. We will notify you at least 30 days in advance of any price changes to your active subscription.
7. Billing and Payments
All payments are processed through Lemon Squeezy, our Merchant of Record. By subscribing to a paid plan, you agree to Lemon Squeezy's terms of service in addition to these Terms.
Subscriptions are billed on a monthly recurring basis. Your billing cycle begins on the date you subscribe to a paid plan (or the date your free trial ends, if applicable). Payment is due at the start of each billing cycle.
Lemon Squeezy, as the Merchant of Record, handles all payment processing, invoicing, tax calculation, and tax remittance. Lemon Squeezy accepts major credit cards, debit cards, and select alternative payment methods. All invoices and receipts are available through your Claudessa dashboard and via email.
If a payment fails, we will attempt to charge your payment method again and notify you via email. If payment cannot be collected after reasonable attempts, your account may be suspended until the outstanding balance is resolved.
8. Cancellation and Refunds
You may cancel your subscription at any time through your Claudessa dashboard or by contacting us at [email protected]. Upon cancellation:
- Your subscription will remain active until the end of the current billing period. You will not be charged for subsequent periods.
- AI call answering will continue to function until the end of your paid period.
- After your subscription ends, you will retain read-only access to your call logs and dashboard data for 90 days.
- After the 90-day retention window, your data will be permanently deleted in accordance with our Privacy Policy.
Claudessa does not offer prorated refunds for partial months of service. If you cancel mid-cycle, you will continue to have access to the Service for the remainder of that billing period.
Refund requests for exceptional circumstances (e.g., extended service outages, billing errors) may be submitted to [email protected] and will be reviewed on a case-by-case basis.
9. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:
- Use the Service for any business or activity that is illegal, fraudulent, or deceptive
- Use the Service to make outbound robocalls, telemarketing calls, or any unsolicited automated calls
- Provide false, misleading, or inaccurate business information during onboarding
- Attempt to reverse-engineer, decompile, or extract the underlying AI models, algorithms, or source code
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Use the Service to collect, store, or transmit personally identifiable information in violation of applicable laws
- Resell, sublicense, or redistribute access to the Service without written authorization from Claudessa
- Use the Service to handle calls related to emergency services (911), medical emergencies, or situations requiring immediate human intervention
- Transmit any content that is abusive, threatening, defamatory, or otherwise objectionable
- Exceed the call volume limits of your subscription plan through automated or artificial means
Claudessa reserves the right to suspend or terminate accounts that violate these acceptable use requirements, with or without prior notice depending on the severity of the violation.
10. AI Disclaimer
Important Notice About AI-Generated Responses
Claudessa uses artificial intelligence to answer calls and interact with your customers. While we strive for accuracy, AI-generated responses are not guaranteed to be perfect, complete, or error-free in every situation.
You acknowledge and agree that:
- The AI may occasionally misunderstand a caller's request, mispronounce words, or provide an imprecise response
- The AI operates based on the knowledge base built during onboarding and subsequent updates you provide; the quality of AI responses depends in part on the completeness and accuracy of the information you supply
- The AI is not a substitute for licensed professional advice (legal, medical, financial, or otherwise)
- You are responsible for reviewing call summaries and following up with callers as needed
- Claudessa is not liable for business outcomes (lost leads, scheduling errors, miscommunicated pricing) resulting from AI-generated responses
- The AI may not correctly handle ambiguous, unusual, or highly complex caller requests and will attempt to take a message or offer to have a human return the call in such cases
We continuously work to improve our AI's accuracy and reliability. You can help by keeping your business information up to date and providing feedback on call quality through your dashboard.
11. Call Recording and Consent
Claudessa records and transcribes calls handled by the Service for the purposes of providing call summaries, improving AI accuracy, quality assurance, and dispute resolution. By using the Service, you consent to the recording and transcription of all calls processed through Claudessa.
Your Responsibility for Caller Consent: Many U.S. states require all parties to a call to consent to recording ("two-party consent" or "all-party consent" states). You are solely responsible for:
- Understanding the call recording consent laws applicable in your state and the states where your callers are located
- Configuring your Claudessa AI to disclose call recording to callers where legally required (a default disclosure message is provided and can be customized)
- Ensuring compliance with all applicable federal, state, and local laws regarding call recording and consent
Claudessa provides tools to enable recording disclosures but does not provide legal advice on compliance requirements. We recommend consulting with a qualified attorney regarding the call recording laws applicable to your business.
12. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your data and the data of your callers.
You acknowledge that the Service processes personal information of your customers (callers), including names, phone numbers, voicemail content, and call recordings. You represent and warrant that your use of the Service complies with all applicable data protection and privacy laws, and that you have the right to process your customers' data through the Service.
Call recordings, transcriptions, and caller data are stored securely and are accessible only to you through your dashboard. Claudessa does not sell or share your caller data with third parties, except as necessary to provide the Service or as required by law.
13. Intellectual Property
Claudessa's IP: The Service, including its AI models, algorithms, software, website, documentation, branding, and all related intellectual property, is owned by Claudessa and its licensors. These Terms do not grant you any ownership interest in the Service. You receive a limited, non-exclusive, non-transferable, revocable license to use the Service solely for your internal business purposes during the term of your subscription.
Your Content: You retain ownership of all business information, knowledge base content, and data you provide to Claudessa during onboarding and through your use of the Service ("Your Content"). You grant Claudessa a limited license to use Your Content solely for the purpose of providing and improving the Service.
Feedback: If you provide suggestions, feature requests, or other feedback about the Service, Claudessa may use that feedback without obligation or compensation to you.
14. Service Availability
Claudessa strives to maintain high availability for the Service. However, we do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to:
- Scheduled maintenance (we will provide advance notice when feasible)
- Unscheduled maintenance to address critical issues
- Third-party service outages (telephony providers, cloud infrastructure, AI model providers)
- Force majeure events beyond our reasonable control

15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLAUDESSA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of revenue, profits, or business opportunities
- Loss of data or business information
- Missed calls, mishandled customer inquiries, or scheduling errors caused by the AI
- Business reputation damage arising from AI-generated responses
- Costs of procuring substitute services
IN NO EVENT SHALL CLAUDESSA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU PAID TO CLAUDESSA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CLAUDESSA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLAUDESSA DOES NOT WARRANT THAT THE AI WILL MEET YOUR SPECIFIC REQUIREMENTS OR THAT ALL CALLS WILL BE HANDLED WITHOUT ERROR.
16. Indemnification
You agree to indemnify, defend, and hold harmless Claudessa and its officers, directors, employees, affiliates, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation, including call recording consent laws
- Any inaccurate or misleading business information you provide to the Service
- Any dispute between you and your customers arising from the AI's handling of a call
- Your failure to comply with data protection laws regarding your customers' personal information processed through the Service
17. Termination
By You: You may terminate your account at any time by canceling your subscription and contacting [email protected] to request account deletion.
By Claudessa: We may suspend or terminate your account immediately and without prior notice if:
- You breach these Terms, particularly the Acceptable Use provisions
- Your account has an outstanding unpaid balance for more than 30 days
- We are required to do so by law or legal process
- We reasonably believe your account is being used for fraudulent or illegal activity
Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to Sections 10, 13, 15, 16, and 19.
18. Modifications to Terms
Claudessa reserves the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Notify you via email to the address associated with your account at least 30 days before the changes take effect
- Provide a summary of the material changes in the notification
Your continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must cancel your subscription before the changes take effect.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware.
Dispute Resolution: Before initiating any formal legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will attempt to resolve the dispute through good-faith negotiation within 30 days. If the dispute cannot be resolved informally, either party may proceed with formal legal action.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Claudessa.
